1. Acceptance of Terms

By accessing or using the Pocket Pet Care website (pocketpetcare.com), creating an account, or booking any service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our website or services.

2. Eligibility

You must be at least 18 years of age to create an account or use our services. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

3. Description of Services

Pocket Pet Care provides in-home pet care services for small and exotic pets in the Seattle, Washington area, including but not limited to pet sitting, feeding, habitat maintenance, and wellness checks. Services are subject to availability and may be modified or discontinued at any time.

Pocket Pet Care does not provide veterinary services, medical diagnosis, or emergency animal care. Nothing on this website or in our services should be construed as veterinary advice. If your pet requires medical attention, contact your veterinarian or an emergency animal hospital.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account and to keep that information up to date.
• You must notify us promptly if you become aware of any unauthorized use of your account.

5. Pet Information, Care, and Assumption of Risk

You are responsible for providing accurate, complete, and up-to-date information about your pets, including species, dietary needs, medical conditions, temperament, behavioral issues, and any special care requirements. You must promptly notify us of any changes to your pet's health or behavior before a scheduled visit. You are also responsible for maintaining current veterinarian contact information so we can reach your veterinarian in case of emergency.

Pocket Pet Care relies on the information you provide to deliver appropriate care. We are not liable for any harm, injury, illness, or loss resulting from inaccurate, incomplete, or outdated information provided by you.

You acknowledge that pet sitting inherently involves risks, including but not limited to the risk of injury, illness, escape, property damage, or death. While Pocket Pet Care will exercise reasonable care in performing services, we cannot guarantee against all such risks. By booking a service, you assume these inherent risks.

Pocket Pet Care is not liable for complications arising from pre-existing medical conditions, undisclosed behavioral issues, or conditions that were not communicated to us.

In the event of a medical emergency and you cannot be reached, you authorize Pocket Pet Care to seek reasonable and necessary emergency veterinary care for your pet. You agree that you are responsible for all veterinary costs incurred in such circumstances.

6. Data Collection and Retention

By using our services, you acknowledge and agree that we collect and retain personal information as described in our Privacy Policy. We retain data for defined periods based on business necessity, legal requirements, and the purposes for which it was collected. Active account data is retained for the duration of your account. Inactive accounts are deleted after 3 years of inactivity. Completed booking records are retained for 3 years for tax and dispute resolution purposes. 7. Disclaimer of Warranties

Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Pocket Pet Care and its owner, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of our website or services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to a booking or use of our services exceed the amount you paid for the specific booking giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pocket Pet Care and its owner, operators, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of our website or services; (b) inaccurate or incomplete information you provide about your pets, their health, or their behavior; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Where feasible, we will provide notice before termination. You may request deletion of your account at any time by contacting us at the email address below. Upon termination, your right to use our services will cease immediately. Your data will be retained and deleted in accordance with the retention schedule described in our Privacy Policy.

11. Intellectual Property

The Pocket Pet Care name, logo, website design, and all original content are the property of Pocket Pet Care. You are granted a limited, non-exclusive, non-transferable license to access and use the website for its intended purposes. Content you submit (such as pet information and care notes) remains your property, but you grant us a license to use it as necessary to provide our services.

12. Governing Law and Disputes

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in King County, Washington. Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve disputes informally by contacting the other party.

13. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. If we make material changes, we will notify you by email or through a prominent notice on our website. Your continued use of our website and services after any changes constitutes your acceptance of the updated terms.
